1. Leieobjektet
Mot betaling av leie får Fremleier en personlig bruksrett til lagerrom. Arealet er avrundet til nærmeste hele kvadratmeter. Fremleier er innforstått med at mindre arealavvik kan forekomme, og at dette ikke gir Fremleier rett til å kreve noen form for kompensasjon. Strømforbruk i utleide garasjer (gjelder ikke vanlige boder) utover 100 kW pr. mnd. vil bli tilleggsfakturert etterskuddsvis. Fremleier godtar automatisk dette ved avtaleinngåelse. Fremleier har rett til adgang gjennom fellesområder i lagerhotellet for frakt til og fra lagerrommet. Fremleier har tilgang til lageret hver dag hele året mellom kl. 06:00 og kl. 23:00.

2. Leietid
Minimum leieperiode er to måneder. Fremleier overtar lagerrommet i den stand det er ved overtakelsen. Hver av partene kan si opp avtalen med én måneds skriftlig varsel, regnet fra 1. dag i den påfølgende kalendermåned. Senest siste dag i leieforholdet skal lagerrommet rengjøres av Fremleier og overleveres tømt for Fremleiers gjenstander. Eiendeler som ikke er fjernet skal anses etterlatt, og tilfaller Fremutleier etter leieforholdets opphør. Etterlater Fremleier søppel og andre gjenstander Fremutleier ikke ønsker å overta, er Fremleier innforstått med at Fremutleier kan kaste eller fjerne disse for Fremleiers regning. Foruten normalt slit og elde, plikter Fremleier å levere lagerrommet tilbake i samme stand som ved overtakelsen.

3. Betaling av leie
Fremleier aksepterer at leie skal betales ved bruk av kredittkort. Ved oppstart av leieforholdet skal Fremleier betale et beløp tilsvarende to måneders leie i forskudd til Fremutleier. Denne betalingen er å anse som leie i minimumsperioden på to måneder. Deretter skal Fremleier betale leien forskuddsvis med månedlige terminer som forfaller til betaling den 1. dagen i hver kalendermåned. Fremleieren er innforstått med at Fremutleier vil kreve et administrasjonsgebyr på kr. 75,- for utarbeidelse og oversendelse av fakturaer. Dette vil også gjelde om kortet ikke er trukket av ulike årsaker, og Fremutleier må utstede faktura. Fremleieren er videre innforstått med at Fremleiers adgangskode blir deaktivert dersom leien ikke betales til avtalt forfall. Dersom leien heller ikke betales etter at Fremutleier har sendt skriftlig betalingspåminnelse til Fremleier med 14 dagers varsel for betaling, kan Fremutleier si opp Fremleieavtalen med umiddelbar virkning. Fremleieren aksepterer i slike tilfeller at Fremutleieren får håndpant etter panteloven § 3-2 i løsøre som måtte befinne seg i lagerboden. Håndpantet skal tjene som sikkerhet for ubetalt leie og andre krav som måtte oppstå som følge av Fremleiers mislighold. Blir leien ikke betalt ved forfall, og heller ikke innen 14 dager etter at Fremutleier deretter har sendt betalingsvarsel, kan Fremutleier kreve tvangsfravikelse («utkastelse») uten søksmål, jf. tvangsfullbyrdelsesloven § 4-18 og § 13-2 tredje ledd bokstav a.

Hvis leiekontrakten er utløpt og Fremleier ikke flytter innen 14 dager etter at Fremutleier deretter har sendt fraflyttingsvarsel, kan Fremutleier kreve tvangsfravikelse («utkastelse») uten søksmål, jf. tvangsfullbyrdelsesloven § 4-18 og § 13-2 tredje ledd bokstav b. Vi forbeholder oss retten til å foreta kredittsjekk av våre kunder; og alle kunder må ha adresse i Norge. Det kan forekomme krav om gebyr ved ikke å overholde betingelsene beskrevet i denne avtale. Bodhotell.no AS er registrert i merverdiavgiftsregisteret, hvoretter leie vil bli fakturert med tillegg av mva.

4. Regulering av leien
Fremutleier kan uten samtykke fra Fremleietaker med to måneders skriftlig varsel pr. e-post til Fremleier kreve leien justert med virkning fra den første dagen i den påfølgende kalendermåneden. Husleielovens fravikelige bestemmelser om leieregulering skal ikke gjelde i dette leieforholdet.

5. Bruk av leieobjektet
Leieobjektet kan kun benyttes til lagerformål. Fremleier plikter å bruke lagerrommet med tilbørlig aktsomhet, holde lagerrommet i alminnelig god stand og for øvrig følge de ordensregler som til enhver tid gjelder for leieobjektet. Det er ikke tillatt å oppbevare noen form for økologiske landbruksprodukter, akvakulturprodukter, næringsmidler eller mat/ fôr. Bruken av leieobjektet må ikke stride mot lov eller vedtak av offentlig myndighet og må ikke foregå slik at den nedsetter eiendommens omdømme eller ved rystelse, støy, lukt o.l. sjenerer gårdeier, Fremutleier eller andre Fremleietakere. Fremleier får utdelt et nøkkelkort med en kode som gir tilgang til lokalet. Koden er personlig og skal ikke meddeles til andre. Videre får Fremleier utlevert en hengelås med kode som skal benyttes til sikring av lagerrommet. Tapt eller ikke-returnert nøkkelkort/hengelås må erstattes av Fremleier. Fremutleier utstyrer lokalet med traller som Fremleier kan disponere i lokalet i forbindelse med frakt av gjenstander til og fra lagerrommet. Fremutleie av Leieobjektet er ikke tillatt med mindre Fremutleier gir et uttrykkelig, skriftlig forhåndssamtykke til dette. Fremleier er innforstått med at lokalet videoovervåkes og aksepterer at opptak kan bli lagret av sikkerhetshensyn. Det er forbudt å oppbevare gass og eksplosiver inne i bygningene. Det oppfordres til å pakke tekstiler/klesplagg i lufttette bokser, dette for å hindre spredning av eventuelle skadelige insekter.

6. Forsikring
Fremleier er selv ansvarlig for å tegne de forsikringer Fremleier mener er nødvendige i forbindelse med Fremleieavtalen. Fremutleier bærer intet ansvar for skader, kostnader eller tap som måtte oppstå ved innbrudd, brann, røykutvikling, strømavbrudd, vannskade eller av andre årsaker. Fremleier er i denne forbindelse innforstått med at Fremutleier skal holdes skadesløs.

7. Ansvar ved brann
Fremleier er kjent med at bodhotellet er ubetjent. Dvs. at den enkelte har ansvar for egen sikkerhet dersom det skulle oppstå en hendelse som krever evakuering av bygget. Rømningsveier er merket og vi ber den enkelte Fremleier gjøre seg kjent med disse. Det henger rømningsplaner/tegninger/branninstruks ved alle innganger som Fremleier kan gjøre seg kjent med. Ved varsel om branntilløp skal Fremleier umiddelbart forlate bygningen.

8. Husleieloven
Ved motstrid mellom leieavtalen og husleieloven går leieavtalen foran.
9. Innlevering av nøkler og kort
Husk å levere inn hengelås og nøkkelkort samme dag som du flytter ut av boden, ellers vil Fremleier bli belastet med et gebyr på kr. 250,-.

AGREEMENT FOR RENTAL OF STORAGE ROOM
1. The leased property
Upon payment of the agreed rent the Subtenant has a personal right to use storage room. The area is rounded off to the nearest whole square foot. The Subtenant accepts that minor deviations from the agreed area may occur, and that this does not entitle the Subtenant to any claim for compensation. All electric consumption in rented garages above 100 kW/month will be accumulated and billed the Subtenant. By becoming a subtenant you automatically agree to this term. The Subtenant shall have access through the common areas of the warehouse for transportation in and out of the storage room. The Subtenant has access to the warehouse every day of the year between 06:00 and 23:00.

2. Term of lease
Minimum term of lease is two months. The storage room is handed over to the Subtenant in the state it is in at the time of the handover. Either party may terminate the agreement with one month’s written notice, counting from the 1st day of the following calendar month. On the last day of lease term at the latest, the storage room shall before handover be cleaned by the Subtenant and emptied for the Subtenant’s belongings. Belongings that are not removed shall be deemed abandoned and fall to the Landlord after termination of the lease. If the Subtenant leaves behind waste and other belongings the Landlord does not want to take possession of, the Subtenant acknowledges that the Landlord may throw or remove such waste/belongings on the Subtenant’s expense. With the exception of normal wear and tear, the Subtenant shall return the storage room to the condition it was in at the commencement of the lease.

3. Payment of rent
The Subtenant accepts to pay by credit card. Upon the commencement of the tenancy, the Subtenant is obliged to pay an amount equivalent to two month’s rent in advance to the Landlord. This payment is to be considered as payment of rent for the minimum term. Thereafter, the rent shall be paid in advance with monthly payments falling due on the 1st day of each calendar month. The Subtenant accepts that the Landlord will charge an administration fee of NOK 75,- for preparation and submission of invoices. This will also be charged if the credit card, for any reason, has not been charged. Furthermore, the Subtenant accepts that his access code will be disabled if the rent is not paid on the agreed due date. If the rent is still not paid when the Landlord has sent a written reminder to the Subtenant with 14 days’ notice of payment, the Landlord is entitled to terminate the Sublease agreement with immediate effect. The Subtenant accepts under such circumstances that the Landlord obtains pledge in accordance with the Norwegian Mortgage Act section 3-2 on the movable property that is contained in the storage room. The pledge shall serve as security for unpaid rent and other claims that may arise as a result of the Subtenant’s default. If the rent is not paid when due, or within 14 days after the Landlord’s notice hereof, the Landlord is entitled to require eviction without litigation, cf. the Norwegian Enforcement Act section 4-18 and section 13-2 third subparagraph section A. If the lease agreement is expired and the Subtenant does not move within 14 days after the Landlord’s notice of deviation, the Landlord is entitled to require eviction without litigation, cf. the Norwegian Enforcement Act section 4-18 and section 13-2 third subparagraph section B. We reserve the right to perform a credit check of our customers. The Landlord reserves the right to issue fees if the Subtenant is in breach of the terms of this agreement. Bodhotell.no AS is registered in the VAT register (No: “Merverdiavgiftsregisteret”), after which rent will be invoiced with the addition of VAT.

4. Price adjustment
The Landlord can at it’s own discretion, without consent from Subtenant, with two month’s written notice pr. e-mail to the Subtenant, demand the rent adjusted with effect from the first day of the following calendar month. The non-mandatory provisions of the Norwegian Tenancy Act on price regulation shall not apply to this sublease.

5. Use of the storage room leased object
The storage room shall only be used for storage purposes. The Subtenant is obliged to use the storage rooms with due care, keeping it in general good condition and otherwise comply with the rules applying to the storage rooms at any time. Use of the storage room shall not be in breach of law or any decision of a public authority and must not be such that it reduces the property’s reputation or causes shaking, noise, odor, etc. be of nuisance to the property owner, Landlord or other subtenants. It is not permitted to store any kind of organic agricultural products, aquaculture products or food of any kind. The Subtenant is given a key card with a code that provides access to the premises. The code is personal and shall not be communicated to others. Moreover, the Subtenant is given a padlock with code to be used to secure the storage room. Lost or non-returned key/lock must be compensated by the Subtenant. The Landlord equips the premises with trolleys that the Subtenant may use on the premises in connection with transportation of objects in and out of the storage room. Subletting of the storage room is not permitted unless the Landlord provides an express, prior written consent. The Subtenant accepts that the premises are video monitored and accepts that recordings can be stored for security purposes. It is forbidden to store gas and explosives inside the buildings. The Subtenant is encouraged to pack textiles/clothing in airtight boxes to prevent the spread of any potentially harmful insects.

6. Insurance
The Subtenant is responsible for taking out the insurances the Subtenant deems necessary in connection with the Sublease agreement. The Landlord accepts no responsibility for damages, costs or losses that may arise from burglary, fire, smoke, power outages, water damage or other causes. In this regard the Subtenant accepts that the Landlord shall be indemnified.

7. In case of fire
The Subtenant is aware that the storage center (Bodhotell) is unattended. This means that the individual subtenant is responsible for their own safety should an incident occur that requires evacuation of the building. Escape routes are marked, and we ask the individual tenant to familiarize themselves with these. Escape plans/drawings/fire instructions are posted at all entrances for the subtenants to familiarize themselves with. In the event of a fire, the subtenants must leave the building immediately.

8. The Norwegian Tenancy Act
The Sublease agreement shall prevail in case of conflict between the provisions of the Sublease agreement and the non-mandatory provisions of the Norwegian Tenancy Act.

9. Return of key card and pad lock
Remember to hand in your key card and pad lock on the day you clean out your storage room. If not, you will have to pay a fine of NOK 250, to compensate for the loss.

This will also be charged if the creditcard do not has been charged of different reasons. Furthermore, the Sub-tenant accepts that his access code will be disabled if the rent is not paid on the agreed due date. If the rent is still not paid when the Landlord has sent a written reminder to the Sub-tenant with 14 days’ notice of payment, the Landlord is entitled to terminate the Sublease agreement with immediate effect. The Sub-tenant accepts under such circumstances that the Landlord obtains pledge in accordance with the Norwegian Mortgage Act s. 3-2 on the movable property that is contained in the storage room. The pledge shall serve as security for unpaid rent and other claims that may arise as a result of the Sub-tenant’s default.If the rent is not paid when due, or within 14 days after the Landlord’s notice hereof, the Landlord is entitled to require eviction without litigation, cf. the Norwegian Enforcement Act s. 4-18 and s. 13-2, third subparagraph section A.If the lease agreement is expired and the Sub-tenant does not move within 14 days after the Landlord’s notice of deviation, the Landlord is entitled to require eviction without litigation, cf. the Norwegian Enforcement Act s. 4-18 and s. 13-2, third subparagraph section B.We reserve the right to credit our customers.It can be issue for charge sub-tenant for extra, if the terms of payment do not follow this rules.

4. Price adjustment
The Landlord can require adjustment of the price to market price with effect from 1 January each year, however not before six months from the commencement of the lease. If the parties do not agree upon the market price, the amount shall be determined with final and binding effect by three experts appointed by the parties jointly. The provisions of the Norwegian Tenancy Act on price regulation shall not apply to this sublease.

8. The Norwegian Tenancy Act
